Terms of Service

These Terms govern your access to and use of the Pounamu Luck website and apps at pounamuluck.com (the “Service”). By using the Service, you agree to these Terms.

1) Eligibility (18+)

You must be at least 18 years old and able to form a binding contract to use the Service. Do not use the Service if it is unlawful for you to do so.

2) Social casino only (no real-money gambling)

  • The Service is for entertainment only and does not offer real-money gambling.
  • No prizes of real-world value are offered through gameplay.
  • Virtual coins/credits/items (“Virtual Currency”) have no cash value, are not redeemable for money or money’s worth, and are non-transferable except as expressly allowed in the Service.

3) Purchases

You may be able to buy Virtual Currency or features via in-app purchases. Purchases provide a limited, revocable licence to use the purchased content within the Service; they are not deposits, are not banked or insured, and are not refundable except where required by applicable law or the relevant app store policy.

4) Acceptable use

  • Do not cheat, exploit bugs, automate play, or interfere with the Service’s security or integrity.
  • Do not harass others, post unlawful content, or infringe any rights.
  • Do not use the Service for commercial purposes without our written consent.

5) Accounts, suspension, and termination

You are responsible for your account credentials and activity. We may suspend or terminate access (including Virtual Currency and progress) if we reasonably believe you breached these Terms, engaged in fraud/abuse, or to protect the Service or other users.

6) Intellectual property

The Service, including software, design, trademarks, and content, is owned by or licensed to Pounamu Luck Limited. You receive a personal, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.

7) Disclaimers and limitation of liability

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we exclude warranties and limit liability for indirect or consequential loss, loss of data, profits, or goodwill. Nothing in these Terms limits any rights you may have under New Zealand law that cannot be excluded (including the Consumer Guarantees Act 1993 where applicable) or liability that cannot be limited.

8) Complaints and disputes

Please contact us first so we can try to resolve any issue. If we can’t resolve a dispute, these Terms are governed by New Zealand law and the courts of New Zealand have non-exclusive jurisdiction.

9) Changes

We may update these Terms from time to time. The “Last updated” date shows when changes were made. Continued use after changes take effect means you accept the updated Terms.
